Terms of Service
Last update: June 1, 2026
Welcome to Fouuunt!
Fouuunt, Inc. is a Delaware corporation operating the Fouuunt service from the United States. These Terms form a binding legal agreement between you and Fouuunt, Inc. ("Fouuunt," "we," "us").
The Service is operated from and intended for users in the United States. We make no representation that the Service is appropriate or available for use in other locations. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
By using our service, you agree to these Terms of Service and the corresponding Privacy Policy.
Fouuunt is a media file storage and sharing platform.
The service is intended for legitimate personal and professional use.
To use Fouuunt, you must create an account using a one-time code sent to your email address, or by signing in with Google. The security of your Fouuunt account is tied to the security of the email account or Google account you use to sign in — if that underlying account is compromised, your Fouuunt account may be too.
You must be at least 16 years old, or the age of digital consent in your jurisdiction, whichever is older, to use the Service.
Fouuunt reserves the right to suspend or terminate accounts in case of violation of these Terms.
Certain features of the Service permit file uploads without requiring full account registration at the time of upload. Such uploads remain subject to all Acceptable Use restrictions in Section 5, carry no storage persistence guarantee, and may be permanently deleted at any time at Fouuunt's sole discretion. By using these features, you represent that you meet the minimum age requirement set out above and accept full legal responsibility for the content you upload. Account creation may occur as part of your use of these features; standard account terms apply to any account created.
Storage limits and features vary by plan tier as described on our pricing page at fouuunt.com/pricing.
Fouuunt is not a Content Delivery Network (CDN) for high-traffic external websites. We reserve the right to throttle speeds or disable direct linking if your bandwidth usage exceeds reasonable limits (e.g., significantly exceeding the average user consumption) or impacts service stability.
Fouuunt reserves the right to delete Free accounts (and all associated files) that have been inactive (no login) for a period longer than 12 months. We will send notice at least 30 days before deletion to the registered email address.
It is your sole responsibility to maintain independent backup copies of your files. Fouuunt is not a backup service.
Temporary sessions uploads are not subject to any storage persistence guarantee and may be deleted at any time at Fouuunt's sole discretion.
Fouuunt subscriptions
Paid plans are subscriptions billed monthly. Current pricing and plan details are available at fouuunt.com/pricing.
Payments are generally non-refundable as this is a digital service with immediate access. However, statutory consumer rights in your jurisdiction may apply.
Subscription automatically renews unless canceled before the billing cycle ends.
You are responsible for providing valid and current billing information.
In case of payment failure, the account will revert to the Free plan with its associated storage limit. If your stored data exceeds the Free plan limit, you will have a grace period of 30 days to download your data before we delete the excess files. During this grace period, you may access and download files but cannot upload new content.
Invoice payments and Stripe Connect Org owners may connect a Stripe account and collect one-time invoice payments from clients through Fouuunt-hosted checkout. For invoice payments, the org owner is the seller and is solely responsible for the underlying goods or services, pricing, taxes, refunds, chargebacks, and client support. Fouuunt provides software only and is not a party to those transactions. Stripe Connect onboarding is subject to Stripe's terms and policies, including Stripe's Connected Account Agreement for Standard accounts. Fouuunt does not control Stripe's approval decisions, payout timing, or account restrictions. Org owners must maintain a valid Stripe account, provide accurate invoice details, comply with applicable laws (including anti-fraud and prohibited-business rules), and handle payment disputes directly with payers. ACH and bank-transfer invoice payments may include a platform fee retained by Fouuunt. Card invoice payments do not include a platform fee at this time. We may change platform fees with reasonable notice. Payment of an invoice may unlock shared content according to the invoice settings configured by the owner. Fouuunt does not guarantee delivery of the owner's work product or services. You may not use invoice payments for illegal, deceptive, or Stripe-prohibited activity.
You MAY NOT use Fouuunt to:
Upload illegal content (including CSAM), malware, or copyrighted material without authorization;
Use the service as a remote file server for other applications (hotlinking abuse);
Host deceptive pages (phishing) or engage in fraudulent behavior;
Collect invoice payments for illegal, deceptive, or Stripe-prohibited goods or services.
CSAM Policy: We have a zero-tolerance policy for Child Sexual Abuse Material. In compliance with US Federal Law (18 U.S.C. § 2258A), we report all instances of apparent CSAM to the NCMEC. DMCA: We respect intellectual property rights. If you believe your content has been infringed, please send a notice to our Designated Copyright Agent at help@fouuunt.com containing all elements required by 17 U.S.C. § 512(c)(3), including: (a) a physical or electronic signature of the rights holder or authorized agent; (b) identification of the copyrighted work claimed to be infringed; (c) the specific URL of the allegedly infringing material; (d) your contact information; (e) a statement of good-faith belief that the use is unauthorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act. These restrictions apply equally to anonymous and unauthenticated users. Fouuunt reserves the right to remove any content — including from temporary sessions — that we reasonably believe violates these Terms, without notice.
You retain ownership of your files.
You grant Fouuunt a license to store, process, and display your files solely to provide the Service.
We are not responsible for the content you upload. You bear full legal responsibility for your files.
You may request an export of your data by contacting help@fouuunt.com.
Shared links to files may become inaccessible after account termination or deletion.
Enabling paid invoices does not transfer ownership of your files or define licensing terms for payers. You are responsible for the commercial terms between you and your clients.
THE SERVICE IS PROVIDED 'AS IS' WITHOUT WARRANTIES OF ANY KIND.
TO THE FULLEST EXTENT PERMITTED BY LAW, FOUUUNT'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO FOUUUNT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
The liability cap above applies to amounts paid to Fouuunt for subscriptions and platform fees. Fouuunt is not liable for invoice payment disputes, owner non-performance, chargebacks, or Stripe payout issues between org owners and their clients.
We are not liable for data loss, lost profits, or indirect damages.
The Fouuunt software and design are owned by the Company.
You may not copy, reverse engineer, or resell the software.
We may update these Terms. Continued use after updates constitutes acceptance.
You may cancel at any time through your account settings.
We may terminate or suspend your access immediately, without prior notice or liability, if you breach these Terms, if your account is associated with illegal content, or if continued service would expose Fouuunt to legal or security risk.
For paying users in good standing, if we terminate the Service or your account for any other reason (including discontinuation of the Service or a business decision unrelated to your conduct), we will provide at least 30 days' notice by email and an opportunity to export your data before termination takes effect.
Upon termination, your right to use the Service will immediately cease. Files from terminated accounts are scheduled for permanent deletion in accordance with the Privacy Policy.
Disconnecting Stripe or terminating your account does not automatically refund invoice payments already collected. Refunds for client invoice payments are handled by the org owner through Stripe.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted remotely (via document submission or video conference). You agree to waive any right to a jury trial or class action. This arbitration agreement does not apply to claims that, by applicable federal law, cannot be subject to pre-dispute arbitration agreements, including claims of sexual harassment or sexual assault under the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021.
